In Prince Edward Island, where no comprehensive legislation exists, following the decision of the Supreme Court of Canada in Western Canadian Shopping Centres Inc. v. Dutton, 2 S. C. R.

There are three ways a case can be heard in the Supreme Court: ( 1 ) filing directly in the Supreme Court ; ( 2 ) filing in a lower federal court, such as a district court, and appealing all the way up to the Supreme Court ; ( 3 ) filing in a state court, appealing all the way up through the state's highest courts, and then appealing to the Supreme Court on an issue of federal law.

Mabo v Queensland ( No 2 ) ( commonly known as Mabo ) was a landmark High Court of Australia decision recognising native title in Australia for the first time.

Five judgments were delivered in the High Court, by ( 1 ) Justice Brennan, ( 2 ) Justice Deane and Justice Gaudron, ( 3 ) Justice Toohey, ( 4 ) Justice Dawson, and ( 5 ) Chief Justice Mason and Justice McHugh.
