In 1892 Pinchback was part of the Comité des Citoyens ( Citizens ' Committee ) which set up the New Orleans civil-rights actions of Homer Plessy as a challenge of segregationist laws in public transportation.

Roswell B. Mason ( September 19, 1805January 1, 1892 ; buried in Rosehill Cemetery ) served as mayor of Chicago, Illinois ( 1869 – 1871 ) for the Citizens Party.

On June 7, 1892, Plessy bought a first class ticket at the Press Street Depot and boarded a " whites only " car of the East Louisiana Railroad in New Orleans, Louisiana, bound for Covington, Louisiana.

In 1892, Homer Plessy, who was of mixed ancestry and appeared to be white, boarded an all white railroad car between New Orleans and Covington, Louisiana.

On any other day in 1892, Plessy with his pale skin color could have ridden in the train car restricted to white passengers without notice.

On June 7, 1892, Plessy, then thirty years old and resembling in skin color and physical features a white male, bought a first-class ticket on the East Louisiana Railroad running between New Orleans and Covington, the seat of now suburban St. Tammany Parish.

On February 12, 2009, the Plessy & Ferguson Foundation of New Orleans honored the successes of the civil rights movement by taking part in the placing of a historical marker at the corner of Press and Royal streets, the site of Homer Plessy ’ s arrest in New Orleans in 1892.
