McLean's major break came when Mediarts was taken over by United Artists Records thus securing for his second album, American Pie, the promotion of a major label.

The Day the Music Died, dubbed by Don McLean's song " American Pie ", was an aviation accident that occurred on February 3, 1959, near Clear Lake, Iowa, where rock and roll musicians Buddy Holly, Ritchie Valens, and J. McLean's first unlicensed boxing match came about as a result of a chance meeting while in his late teens: when his car broke down in the Blackwall Tunnel, rather than using his superior physical strength to push it, he abandoned it and went to buy a replacement from an associate known as Kenny Mac, a gypsy used car salesman in Kingsland Road, Hackney, only to find the replacement quickly failed too.

McLean's libertarian bent prevented him from pursuing a direct suit against Phillip Morris, but he did become an anti-smoking advocate.

In 1996, McLean's widow and son filed suit for wrongful death against Philip Morris, maker of Marlboro, claiming that they encouraged or even required cigarette smoking which caused his lung cancer.
