Decided simultaneously with a companion case, Doe v. Bolton, the Court ruled that a right to privacy under the due process clause of the 14th Amendment extended to a woman's decision to have an abortion, but that right must be balanced against the state's two legitimate interests in regulating abortions: protecting prenatal life and protecting women's health.
The Justices delayed taking action on Roe and a closely related case, Doe v. Bolton, until they decided Younger v. Harris, as they felt that the appeals raised difficult questions on judicial jurisdiction, and United States v. Vuitch, where they considered the constitutionality of a District of Columbia statute that criminalized abortion except where the mother's life or health was endangered.

The law was struck down, legalizing abortion for any woman for any reason, up through the first trimester, with possible restrictions for maternal health in the second ( the midpoint of which is the approximate time of fetal viability ), and possibly illegal in the third with exception for the mother's health, which the court defined broadly in Doe v. Bolton.
Citing the Supreme Court case of Doe v. Bolton, some pro-life supporters have asserted that the word " health " would render any legal restriction meaningless, because of the broad and vague interpretation of " health ".

However, the decision in Morgentaler is actually much closer in terms of the issues to the decision ( also in 1973 ) of the U. S. Supreme Court in Doe v. Bolton 410 U. S. 179, than to those in Roe.
