The third ( GCIII ) and fourth ( GCIV ) Geneva Conventions are the two most relevant for the treatment of the victims of conflicts.

Protected person is the most important definition in this section because many of the articles in the rest of GCIV only apply to Protected persons.

Article 6 restricts the length of time that most of GCIV applies:

Most unprivileged combatants who do not qualify for protection under the Third Geneva Convention do so under the Fourth Geneva Convention ( GCIV ), which concerns civilians, until they have had a " fair and regular trial ".

GCIV emphasised an important change in international law.

If a combatant does not qualify as a POW, then, if they qualify as a protected person, they receive all the rights which a non-combatant civilian receives under GCIV, but the party to the conflict may invoke Articles of GCIV to curtail those rights.

It is likely that if they are found to be an " unlawful combatant " by " a competent tribunal " under GCIII Article 5, and if they are a protected person under GCIV, that the Party to the conflict will invoke GCIV Article 5.

A non-combatant civilian " in the hands " of an enemy or an Occupying Power often gains rights through the Geneva Convention Relative to the Protection of Civilian Persons in Time of War, 12 August 1949 ( GCIV ), if they qualify as a " protected person ".

If the individual fulfills the criteria as a protected person, they are entitled to all the protections mentioned in GCIV.

Prisoners of War are covered by the Third Geneva Convention ( GCIII ) until and unless " their status has been determined by a competent tribunal ( GCIII Art 5 ) to be that of a non-combatant or an unlawful combatant, in which case they are covered by Fourth Geneva Convention ( GCIV ) unless they are " Nationals of a State which is not bound by the Convention are not protected by it.

But even if they are covered by GCIV the US can waver a detainee's GCIV rights by invoking GCIV Article 5.

Also, nationals of a State not bound by the Convention are not protected by it, and nationals of a neutral State in the territory of a combatant State, and nationals of a co-belligerent State, cannot claim the protection of GCIV if their home state has normal diplomatic representation in the State that holds them ( Article 4 ), as their diplomatic representatives can take steps to protect them.

For those nations that have ratified Protocol I of the Geneva Conventions, are also bound by Article 45. 3 of that protocol which curtails GCIV Article 5.

Civilians are covered by GCIV Article 3:

" POW status under GCIII has far fewer exemptions than " Protected Person " status under GCIV.
