Hale was born on 1 November 1609 in West End House ( now known as The Grange or Alderley Grange ) in Alderley, Gloucestershire to Robert Hale, a barrister of Lincoln's Inn, and Joanna Poyntz.

Although unsuccessful, Hale was then called to represent William Laud, the Archbishop of Canterbury, during his impeachment by the House of Commons in October 1644.

After suffering for ten more months, Hale died on 25 December 1676 at his country home, The Lower House ( now the site of the present day Alderley House ).
