* 1986 – The U. S. Supreme Court rules in Bowers v. Hardwick that states can outlaw homosexual acts between consenting adults.

Bowers v. Baystate Technologies.

The 8th Circuit case of Davidson & Associates v. Jung determined that such clauses are enforceable, following the Federal Circuit decision of Baystate v. Bowers.

It was the first Supreme Court case to deal with LGBT rights since Bowers v. Hardwick ( 1986 ), when the Court had ruled that a law criminalizing homosexual sex was constitutional.

The decision in Romer set the stage for Lawrence v. Texas ( 2003 ), where the Court overruled its decision in Bowers.

He noted that the majority's result stood in flat contradiction to the court's earlier decision in Bowers v. Hardwick, 478 U. S. 186 ( 1986 ), in which it had ruled that laws outlawing sodomy are not unconstitutional.

Since Romer stood in obvious tension with the Court's earlier decision in Bowers v. Hardwick,, it laid the groundwork for 2003's Lawrence v. Texas,, which overturned Bowers.

This effect was re-affirmed in Bowers v. Kerbaugh-Empire Co., 271 U. S. 170 ( 1926 ), in which the Supreme Court reviewed Pollock, the Corporation Excise Tax Act of 1909 and the Sixteenth Amendment, and concluded that " t was not the purpose or effect of that amendment to bring any new subject within the taxing power.

Without stating a standard of review in the majority opinion, the court overruled Bowers v. Hardwick ( 1986 ), declaring that the " Texas statute furthers no legitimate state interest which can justify its intrusion into the personal and private life of the individual.

The court overturned its previous ruling on the same issue in the 1986 case Bowers v. Hardwick, where it upheld a challenged Georgia statute and did not find a constitutional protection of sexual privacy.

In Bowers v. Hardwick ( 1986 ), the Supreme Court heard a constitutional challenge to sodomy laws brought by a man who had been arrested, but was not prosecuted, for engaging in oral sex with another man in his home.

They also asserted a right to privacy and that the Supreme Court's decision in Bowers v. Hardwick that found no privacy protection for consensual sex between homosexuals was " wrongly decided ".

The majority opinion overruled Bowers v. Hardwick and implicitly invalidated similar sodomy statutes in 13 other states.

Bowers v. Hardwick should be and now is overruled.

He noted that the same rationale used to overturn Bowers could have been used to overturn Roe v. Wade, which the Justices in the majority in Lawrence had recently upheld in Planned Parenthood v. Casey.

Burger was opposed to gay rights as he wrote a famous concurring opinion in the Court's 1986 decision upholding a Georgia law criminalizing sodomy ( Bowers v. Hardwick ), in which Burger purported to marshal historical evidence that laws criminalizing homosexuality were of ancient vintage.

A similar case arose at the Bowers ranch in Butte County, and the Superior Court of that county issued similar restraining orders.

This request was immediately approved in a meeting presided by Carlos Bowers, who had proposed the name " Alumni " to the original football team 50 years before.
