Lord Atkin argued that the law should recognize a unifying principle that we owe a duty of reasonable care to our neighbors.

This passage was used in Britain by Lord Atkin in his dissenting judgement in the seminal case Liversidge v. Anderson ( 1942 ), where he protested about the distortion of a statute by the majority of the House of Lords.

After another six-year stint, he was appointed as a Lord of Appeal in Ordinary upon the death of Lord Atkin in 1944 and received as a Law lord a life peerage.

Lord Atkin of Aberdovey

Atkin became a Lord Justice of Appeal in 1919.

From 1928 until his death he was a Lord of Appeal in Ordinary under the title Baron Atkin, of Aberdovey, in the County of Merioneth.

I wish in India there was the lead of Lord Mansfield, Atkin, and Ried and most of Judges who wish to shine and who even depend upon the articles written by lawyers and professors, would learn from these Judges ".

In words of Lord Atkin in Donoghue v Stevenson, " You must take reasonable care to avoid acts or omissions which you can reasonably foresee would be likely to injure your neighbour.

The answer seems to be — persons who are so closely and directly affected by my act that I ought reasonably to have them in contemplation as being so affected when I am directing my mind to the acts or omissions which are called in question .” per Lord Atkin at 44 of SC

But where negligence is involved the tendency has been to apply principles analogous to those stated by Lord Atkin ( cf.

He was the son of Colonel Stuart Low, who died in action in 1942, and Lucy Atkin, daughter of the Lord Atkin.

Lord Justice Atkin < Ref > 2 KB 571, 579-580 </ ref > took a rather different approach, emphasising that there was no " intention to effect legal relations ".

While imprisoned at Launceston Fox wrote, " Christ our Lord and master saith ' Swear not at all, but let your communications be yea, yea, and nay, nay, for whatsoever is more than these cometh of evil.

In 1834 James Frampton, a local landowner, wrote to the Prime Minister, Lord Melbourne, to complain about the union, invoking an obscure law from 1797 prohibiting people from swearing oaths to each other, which the members of the Friendly Society had done.
