`` Article 17, Section 1::

The Secretary of the Treasury, upon the concurrence of the Secretary of State, is authorized and directed, out of the sum covered into the Yugoslav Claims Fund pursuant to subsection ( B ) of this section, after completing the payments of such funds pursuant to subsection ( C ) of this Section, to make payment of the balance of any sum remaining in such fund to the Government of the Federal People's Republic of Yugoslavia to the extent required under Article 1 ( C ) of the Yugoslav Claims Agreement of 1948.

In the event the total of rupees accruing to the Government of the United States of America as a consequence of sales made pursuant to this Agreement is different from the rupee equivalent of $1,276 million, the amounts available for the purposes specified in paragraph 1, Article 2, will be adjusted proportionately.

I have the honor to refer to the Agricultural Commodities Agreement signed today between the Government of the United States of America and the Government of India ( hereinafter referred to as the Agreement ) and, with regard to the rupees accruing to uses indicated under Article 2, of the Agreement, to state that the understanding of the Government of the United States of America is as follows: 1.

With respect to Article 2,, Paragraph 1 ( A ) of the Agreement: ( 1 )

With respect to Article 2,, paragraphs 1 ( B ) and 1 ( C ): Uses of Section 104 ( E ) and Section 104 ( G ) rupees: The Government of India will use the amount of rupees granted or loaned to it by the United States pursuant to paragraphs 1 ( B ) and 1 ( C ) for projects to promote economic development with emphasis upon the agricultural sector including food reserve storage structures and facilities as may from time to time be agreed upon by the authorized representatives of the United States and the authorized representatives of the Government of India, in the following sectors: A.

The Government of India further agrees in cooperation with the Government of the United States, to coordinate the use of grant and loan funds provided for in paragraphs 1 ( B ) and 1 ( C ) of Article 2, with such direct dollar assistance as may be made available by the Government of the United States of America, so that both sources of financing may be channeled to specific and clearly identifiable economic development programs and projects.

With regard to the rupees accruing to uses indicated under Article 2, of the Agreement, the understanding of the Government of the United States of America, with respect to both paragraphs 1 ( B ) and 1 ( C ) of Article 2, is as follows: ( 1 )

Local currency will be advanced or reimbursed to the Government of India for financing agreed projects under paragraphs 1 ( B ) and 1 ( C ) of Article 2, of the Agreement upon the presentation of such documentation as the United States may specify.

The Government of India shall maintain or cause to be maintained books and records adequate to identify the goods and services financed for agreed projects pursuant to paragraphs 1 ( B ) and 1 ( C ) of Article 2, of the Agreement, to disclose the use thereof in the projects and to record the progress of the projects ( including the cost thereof ).

Mr. Justice Black was one of the minority that rested on the Article 1, power.

In this view, supported by only three members of the Court, a power denied by the specific provisions of Article 3, was granted by the generality of Article 1.

Article 5 provides the right to liberty, subject only to lawful arrest or detention under certain other circumstances, such as arrest on reasonable suspicion of a crime or imprisonment in fulfilment of a sentence.

:: Example 2 ( semi-presidential republic ): Title II, Article 12, first sentence of the French Constitution of 1958 states:

The House of Representatives is elected by all Dutch citizens over the age of eighteen ( Article 54 ), except those who have been disqualified by a court sentence as part of their punishment for a crime or those who have been declared incapable by court because of insanity ( Subarticle 2 ).

After these events, the death sentence was reduced to some events in Article 22 of the Mexican Constitution ; however, on June 18, 2008 capital punishment was abolished completely.

Under Article 47 of Protocol I ( Additional to the Geneva Conventions of 12 August 1949, and relating to the Protection of Victims of International Armed Conflicts ) it is stated in the first sentence " A mercenary shall not have the right to be a combatant or a prisoner of war.

Article 110 of the Rome Statute of the International Criminal Court stipulates that for the gravest forms of crimes ( e. g., war crimes, crimes against humanity and genocide ), a prisoner ought to serve two thirds of a fixed sentence, or 25 years in the case of a life sentence.

Under the Constitution of India ( Article 72 ), the President of India can grant a pardon or reduce the sentence of a convicted person, particularly in cases involving capital punishment.

Retroactive application of law is prohibited by the Article 3 of the Polish civil code, and the legal rule prohibiting such retroactive application is commonly memorised as a Latin sentence Lex retro non agit (" A law does not apply retroactively ").

Article 11 of the Treaty of Olympia was a single sentence:

Article 14 ( 5 ) establishes the right of a convicted person to have a higher court review the conviction or sentence, and article 14 ( 7 ) prohibits double jeopardy.

* maximum sentence that a General Court-Martial can impose is the maximum specified in the specific UCMJ Article ( crime ) the accused is convicted of, including death

Some even called for the prosecution of the then Prime Minister and the Minister of Foreign Affairs for the crime of treason, as stated in Article 241 of the Italian Criminal Code, who mandates a life sentence for anybody found guilty of aiding and abetting a foreign power to exert its sovereignty on the national territory.

Under Section II, Article 4 of the Texas Constitution, the Governor cannot grant a pardon or commute a death sentence except with a majority vote recommendation of the Texas Board of Pardons and Paroles, so Bush was constrained in granting clemency even if he had wanted to do so in a case.

Pursuant to the Article 52 ( 1 ) in conjunction with Article 56, first sentence, EPC, European patents shall be granted for inventions which, among other things, involve an inventive step, that is, the invention, having regard to the state of the art, must not be obvious to a person skilled in the art.

(...) The Commission also concludes that, by sentencing Mr. Garza to death in this manner, and by scheduling his execution for December 12, 2000 and thereby exhibiting its clear intention to implement Mr. Garza's sentence, the State had placed Mr. Garza's life in jeopardy in an arbitrary and capricious manner, contrary to Article I of the Declaration.

In addition, to execute Mr. Garza pursuant to this sentence would constitute a further deliberate and egregious violation of Article I of the American Declaration.

The sentence " States Parties shall take all feasible measures to ensure that members of their armed forces who have not attained the age of 18 years do not take a direct part in hostilities " was adapted from Article 77. 2 of the Additional Protocol I to the Geneva Conventions of 12 August 1949, and relating to the Protection of Victims of International Armed Conflicts, adopted in 1977, with an alteration from fifteen years to eighteen years and some other minor modifications.

Article 8 of the 1826 Charter stated that Portuguese citizenship is lost " by those who are banished by sentence ".

Brazilian criminal code Article 135 establishes a prison sentence of 6 months to a year ( doubled should the victim suffer serious bodily harm or death ) for withholding help.

The accused were charged for high treason, punishable by the death sentence under Article 64 of the Penal code of the RSFSR.

Indeed, the European Convention on Human Rights and Fundamental Freedoms in Article 6 requires these features in the legal systems of its signatory states.

A right to education has been created and recognized by some jurisdictions: Since 1952, Article 2 of the first Protocol to the European Convention on Human Rights obliges all signatory parties to guarantee the right to education.

Article 9 of the Universal Declaration of Human Rights states that, " No one shall be subjected to arbitrary arrest, detention or exile.

On 3 May 2011, Michael O ' Flaherty with the United Nations Human Rights Committee published General Comment No. 34 on the ICCPR, which among other comments expresses concern that many forms of " hate speech " do not meet the level of seriousness set out in Article 20.

While Article 10 of the European Convention on Human Rights does not prohibit criminal laws against revisionism such as denial or minimization of genocides or crimes against humanity, as interpreted by the European Court of Human Rights, the Committee of Ministers of the Council of Europe went further and recommended to member governments to combat hate speech under its Recommendation R ( 97 ) 20.

In Europe, Article 2 of the First Protocol to the European Convention on Human Rights, adopted in 1950, obligates all signatory parties to guarantee the right to education.

According to Article 27 of the Universal Declaration of Human Rights, " everyone has the right to the protection of the moral and material interests resulting from any scientific, literary or artistic production of which he is the author ".

::( c ) Article 5 of the European Convention on Human Rights, imported into English law by the Human Rights Act 1998 provides that a person of unsound mind may only be detained where proper account of objective medical expertise has been taken.

Article 15 of the Universal Declaration of Human Rights states that " Everyone has the right to a nationality ," and " No one shall be arbitrarily deprived of his nationality nor denied the right to change his nationality.

Coercive plea bargaining has been criticized on the grounds that it infringes an individual's rights under Article 8 of the European Convention on Human Rights, incorporated in the UK's Human Rights Act 1998.

Protection is also prescribed in the United Nations ' Universal Declaration of Human Rights, Article 17, and in the European Convention on Human Rights ( ECHR ), Protocol 1.

For Europe, Article 8 of the European Convention on Human Rights guarantees the right to respect for private and family life, one's home and correspondence.

would be removed from the protection of Article 10 by Article 17 ' of the European Convention on Human Rights " ( see the Lehideux and Isorni judgement of 23 September 1998 );

Social security is a concept enshrined in Article 22 of the Universal Declaration of Human Rights which states that Everyone, as a member of society, has the right to social security and is entitled to realization, through national effort and international co-operation and in accordance with the organization and resources of each State, of the economic, social and cultural rights indispensable for his dignity and the free development of his personality.

Article 4 of the Universal Declaration of Human Rights states:

Defamation does not affect or hinder the voicing of opinions, but does occupy the same fields as rights to free speech in the First Amendment to the Constitution of the United States, or Article 10 of the European Convention of Human Rights.

This provision, known as the presumption of innocence, is required, for example, in the 46 countries that are members of the Council of Europe, under Article 6 of the European Convention on Human Rights, and it is included in other human rights documents.
