He was born in the village of Ancrum, near Jedburgh, in the County of Roxburgh, Scotland, one of seven children of the Reverend John Livingston, a lineal descendant of the fourth Lord Livingston, ancestor of the earls of Linlithgow and Callendar, a minister of the Church of Scotland, who was sent into exile in 1663 due to his resistance to attempts to turn the Presbyterian national church into an Episcopalian institution.

The heir presumptive to the marquessate is the 13th Marquess younger brother Lord Ralph Kerr, who owns Ferniehirst Castle, Jedburgh, Roxburghshire, which is an ancient family seat that had passed out of family but was repurchased and restored by the 12th Marquess, and Melbourne Hall in Derbyshire.

He was then created Lord Ker of Newbattle, Oxnam, Jedburgh, Dolphinstoun and Nisbet, Viscount of Briene, Earl of Ancram and Marquess of Lothian in 1701.

The 2nd Marquess succeeded his cousin as Lord Jedburgh before succeeding to the Marquessate, and the 6th Marquess was created Baron Ker, of Kersheugh in the County of Roxburgh, in 1821, in the Peerage of the United Kingdom.

James ' son and heir Archibald Douglas was created Duke of Douglas, Marquess of Angus and Abernethy, Viscount of Jedburgh Forest, and Lord Douglas of Bonkill, Prestoun and Robertoun on 10 April 1703.

Sir Andrew Kerr of the Ferniehurst line was created Lord Jedburgh in 1621.

He became Lord Chancellor of Scotland in 1567, and joined Bothwell in the plot to murder the Regent Moray at Jedburgh.

He was styled Master of Jedburgh until 1722, Lord Jedburgh from 1722 to 1735, and Earl of Ancram from 1735 to 1767.

On 6 November 1735, he married Lady Caroline Darcy ( d. 1778 ), daughter of Robert Darcy, 3rd Earl of Holderness, and thereafter assumed the style of Earl of Ancram rather than Lord Jedburgh.
