( Common Article 2: " High Contracting Parties shall furthermore be bound by the Convention in relation to Power which is not a contracting party, if the latter accepts and applies the provisions thereof " ( emphasis added ).

Article 3 in the general section of the Geneva Conventions states that in the case of armed conflict not of an international character ( occurring in the territory of one of the High Contracting Parties ) that each Party to the conflict shall be bound to apply, as a minimum, the following provisions to non-combatants:

The High Contracting Parties solemnly declare in the names of their respective peoples that they condemn recourse to war for the solution of international controversies, and renounce it, as an instrument of national policy in their relations with one another.

** That any armed conflict between two or more " High Contracting Parties " is covered by GCIII ;

** That it applies to occupations of a " High Contracting Party ";

** That the relationship between the " High Contracting Parties " and a non-signatory, the party will remain bound until the non-signatory no longer acts under the strictures of the convention.

The High Contracting Parties, animated by the purpose of giving conventional form to the postulates of the Resolution approved on December 16, 1933, by all the States represented at the Seventh International Conference of American States, held at Montevideo, which recommended to " the Governments of America which have not yet done so that they sign the ' Roerich Pact ', initiated by the Roerich Museum in the United States, and which has as its object, the universal adoption of a flag, already designed and generally known, in order thereby to preserve in any time of danger all nationally and privately owned immovable monuments which form the cultural treasure of peoples ", have resolved to conclude a treaty with that end in view, and to the effect that the treasures of culture be respected and protected in time of war and in peace, have agreed upon the following articles:

The equality of nations being a basic principle of the League of Nations, the High Contracting Parties agree to accord as soon as possible to all alien nationals of states, members of the League, equal and just treatment in every respect making no distinction, either in law or in fact, on account of their race or nationality.

* Other provisions to be inserted by the High Contracting Parties relating to the application of any general conditions attached to mandates, which are suitable to the case in Palestine.

The High Contracting Parties take note of the fact that Her Royal Highness the Princess Victoria Eugénie Julia Ena, according to the due tenor of the law of England, forfeits for ever all hereditary rights of succession to the Crown and Government of Great Britain ...

:" In addition to the provisions which shall be implemented in peace-time, the present Convention shall apply to all cases of declared war or of any other armed conflict which may arise between two or more of the High Contracting Parties, even if the state of war is not recognized by one of them.

: The Convention shall also apply to all cases of partial or total occupation of the territory of a High Contracting Party, even if the said occupation meets with no armed resistance.

The government's argument ( first made by Moshe Dayan in a speech to the UN in 1977 ) is that neither the West Bank nor Gaza were the territory of a " High Contracting Power " at the time they were occupied by Israel and that therefore the Convention does not apply.

Israel's positions have not been accepted by the International Committee of the Red Cross, nor has it been endorsed by the other High Contracting Parties to the Fourth Geneva Convention.

It is understood between the two High Contracting Parties that England agrees to the following conditions relating to her occupation and administration of the Island of Cyprus:

" Now, therefore, upon the evidence and arguments so presented, and after taking into consideration all actions, of the respective Governments and of their representatives authorized in that behalf and of the local governments on either side of the line, whether prior or subsequent to such treaties and award, tending to aid in the interpretation thereof, the High Contracting Parties hereby agree that the location of the international boundary line between the United States and the Dominion of Canada from a point in Passamaquoddy Bay accurately defined in the Treaty between Great Britain and the United States of April 11, 1908, as, lying between Treat Island and Friar Head, and extending thence through Passamaquoddy Bay and to, the middle of Grand Manan Channel, shall run in a series of seven connected straight lines for the distances and in the directions as follows ...."

There were fourteen original High Contracting Parties, including: the United States, Denmark, France, Italy, Japan, the Netherlands, Norway, Sweden, and the United Kingdom of Great Britain and Ireland and British overseas dominions of Canada, Australia, India, South Africa and New Zealand.

Ships and nationals of all the High Contracting Parties shall enjoy equally the rights of fishing and hunting in the territories specified in Article 1 and in their territorial waters.

There shall be established between the High Contracting Parties a close alliance in consecration of their friendship, their cordial understanding and their good relations, and there shall be full and frank consultation between them in all matters of foreign policy which may affect their common interests.

Each of the High Contracting Parties undertakes not to adopt in foreign countries an attitude which is inconsistent with the alliance or might create difficulties for the other party thereto.

Should any dispute between ' Iraq and a third State produce a situation which involves the risk of a rupture with that State, the High Contracting Parties will concert together with a view to the settlement of the said dispute by peaceful means in accordance with the provisions of the Covenant of the League of Nations and of any other international obligation which may be applicable to the case.

Should, notwithstanding the provisions of Article 3 above, either of the High Contracting Parties become engaged in war, the other High Contracting Party will, subject always to the provisions of Article 9 below, immediately come to his aid in the capacity of an ally.

In the event of an imminent menace of war the High Contracting Parties will immediately concert together the necessary measures of defence.

It is understood between the High Contracting Parties that responsibility for the maintenance of internal order in ' Iraq and, subject to the provisions of Article 4 above, for the defence of ' Iraq from external aggression rests with His Majesty the King of ' Iraq.
