John Rawls ( 1921 – 2002 ) proposed a contractarian approach that has a decidedly Kantian flavour, in A Theory of Justice ( 1971 ), whereby rational people in a hypothetical " original position ", setting aside their individual preferences and capacities under a " veil of ignorance ", would agree to certain general principles of justice and legal organization.

For example, philosopher John Rawls distinguishes between jealousy and envy on the ground that jealousy involves the wish to keep what one has, and envy the wish to get what one does not have.

Rawls justifies the Difference Principle on the basis that, since Fair Equality of Opportunity has lexical priority, the Just choice from Pareto optimal scenarios which could occur would be that benefiting the worst-off rather than the best-off.

This for a long time has been the most prevalent defense of toleration by liberals ... It is found, for example, in the writings of American philosophers John Rawls, Robert Nozick, Ronald Dworkin, Brian Barry, and a Canadian, Will Kymlicka, among others.

However, Rawls also insists, like Popper, that society has a reasonable right of self-preservation that supersedes the principle of tolerance: " While an intolerant sect does not itself have title to complain of intolerance, its freedom should be restricted only when the tolerant sincerely and with reason believe that their own security and that of the institutions of liberty are in danger.

In political philosophy Kant has had wide and increasing influence with the major political philosopher of the late twentieth century, John Rawls drawing heavily on his inspiration in setting out the basis for a liberal view of political institutions.

The nature of Rawls ' use of Kant has engendered serious controversy but has demonstrated the vitality of Kantian considerations across a wider range of questions than was once thought plausible.

Although Anarchy State and Utopia has been construed as a response to Rawls's A Theory of Justice, Rawls never provided a direct and sustained rebuttal.

Thanks to the recent discovery and translations of the dominant schools of liberal thought in the Anglo-American world, as found in the works of Isaiah Berlin, John Rawls and Karl Popper, and an appreciation of older liberal traditions ( Kantian, Millian or Lockean ), a new trend of liberalism has appeared among the younger generation of Iranian intellectuals.

Since then he has published widely on Kant and in moral and political philosophy, including various books on John Rawls and global justice.

Pogge insists that Rawls has been importantly misunderstood by his most influential critics, including the libertarian Robert Nozick and the communitarian Michael Sandel.

Unusually for a law professor without a graduate degree in philosophy, he has published significant work in moral and political theory only indirectly related to the law ; Right and Wrong, for instance is an impressive general statement of a Kantian position in ethics with affinities with the work of Thomas Nagel, John Rawls, and Robert Nozick.

Rawls also offered a criticism of utilitarian approaches to questions of political justice.

Moral constructivists like John Rawls and Christine Korsgaard may also be realists in this minimalist sense ; the latter describes her own position as procedural realism.

Rawls also argues that the representatives in the original position would adopt the maximin rule as their principle for evaluating the choices before them.

John Rawls in his Theory of Justice defines a conscientious objector as an individual prepared to undertake, in public ( and often despite widespread condemnation ), an action of civil disobedience to a legal rule justifying it ( also in public ) by reference to contrary foundational social virtues ( such as justice as liberty or fairness ) and the principles of morality and law derived from them.

Rawls is also keying on an intuition that a person does not morally deserve their inborn talents ; thus that one is not entitled to all the benefits they could possibly receive from them ; hence, at least one of the criteria which could provide an alternative to equality in assessing the justice of distributions is eliminated.

The assumptions of the original position, and in particular, the use of maximin reasoning, have also been criticized ( most notably by Kenneth Arrow and John Harsanyi ), with the implication either that Rawls designed the original position to derive the two principles, or that an original position more faithful to its initial purpose would not lead to his favored principles.

Rawls also examines the state of nature between nations.

Rawls also wrote the essay of 1985, " Justice as Fairness: Political not Metaphysical ", on the topic.

Hart also had a strong influence on the young John Rawls in the 1950s, when Rawls was a visiting scholar at Oxford shortly after finishing his PhD.
