I have the honor to refer to the Agricultural Commodities Agreement signed today between the Government of the United States of America and the Government of India ( hereinafter referred to as the Agreement ) and, with regard to the rupees accruing to uses indicated under Article 2, of the Agreement, to state that the understanding of the Government of the United States of America is as follows: 1.

Congress has also created some special judicial bodies known as Article I tribunals to handle some areas of administrative law.

Article 20 I GG is exceptionally significant for the basic organization of Germany.

( The latter prohibition took effect 1 January 1808, the earliest date on which Congress had the power to do so under Article I, Section 9 of the United States Constitution.

When Hong Kong was handed over to China in 1997, Hong Kong retained the common law through a reception statute in Chapter I, Article 8 of the Basic Law of Hong Kong:

Trade of captive-bred animals or cultivated plants of Appendix I species are considered Appendix II specimens, with concomitant requirements ( see below and Article VII ).

A traditionally-minded minority held that the Board's act in publishing Knapp's book constituted a fundamental violation of several by-laws and its legal trust, automatically mandating the offending Board members ' resignations under Article I, Section 9.

In May 2010, the Washington State Supreme Court provided an opinion after it was asked to certify a question referred by the United States District Court for the Eastern District of Washington: “ Whether a public library, consistent with Article I, § 5 of the Washington Constitution, may filter Internet access for all patrons without disabling Web sites containing constitutionally-protected speech upon the request of an adult library patron .” The Washington State Supreme Court ruled that NCRL ’ s internet filtering policy did not violate Article I, Section 5 of the Washington State Constitution.

Many of the Articles in Section I are structured in two paragraphs: the first sets out a basic right or freedom ( such as Article 2 ( 1 ) – the right to life ) but the second contains various exclusions, exceptions or limitations on the basic right ( such as Article 2 ( 2 ) – which excepts certain uses of force leading to death ).

Under clause 17 Article I Section 8 of the Constitution however, Congress has power to " exercise exclusive Legislation in all cases whatsoever " over the federal district ( Washington, D. C .) and other territory ceded to the federal government by the states, such as for military installations.

:: Article I, Third, of the Convention concerning the Duties and Rights of States in the Event of Civil Strife.

* Under Article I, Section 3, Clause 7, upon conviction in impeachment cases, the Senate has the option of disqualifying convicted individuals from holding other federal offices, including the presidency.

" Article I, Section 3, Clause 6 gives the Senate the power to remove impeached officials from office, given a two-thirds vote to convict.

The capitation clause of Article I of the United States Constitution, reads " o capitation, or other direct, tax shall be laid, unless in proportion to the census or enumeration herein before directed to be taken.

The Secretary of the Treasury, upon the concurrence of the Secretary of State, is authorized and directed, out of the sum covered into the Yugoslav Claims Fund pursuant to subsection ( B ) of this section, after completing the payments of such funds pursuant to subsection ( C ) of this Section, to make payment of the balance of any sum remaining in such fund to the Government of the Federal People's Republic of Yugoslavia to the extent required under Article 1 ( C ) of the Yugoslav Claims Agreement of 1948.

The Belgic Confession, used in Reformed churches, devotes a section ( Article 6 ) to " The difference between the canonical and apocryphal books " and asserts that " All which the Church may read and take instruction from, so far as they agree with the canonical books ; but they are far from having such power and efficacy as that we may from their testimony confirm any point of faith or of the Christian religion ; much less to detract from the authority of the other sacred books.

Article 1, section 8, of the Constitution of the United States ( 1789 ), transferred this power to Congress ; " The Congress shall have power ... To coin money, regulate the value thereof, and of foreign coin, and fix the standard of weights and measures ".

On July 3, 2007, the Court ( through the original three-judge panel ) ruled ( 1 ) that the taxpayer's compensation was received on account of a non-physical injury or sickness ; ( 2 ) that gross income under section 61 of the Internal Revenue Code does include compensatory damages for non-physical injuries, even if the award is not an " accession to wealth ," ( 3 ) that the income tax imposed on an award for non-physical injuries is an indirect tax, regardless of whether the recovery is restoration of " human capital ," and therefore the tax does not violate the constitutional requirement of Article I, Section 9, Clause 4, that capitations or other direct taxes must be laid among the states only in proportion to the population ; ( 4 ) that the income tax imposed on an award for non-physical injuries does not violate the constitutional requirement of Article I, Section 8, Clause 1, that all duties, imposts and excises be uniform throughout the United States ; ( 5 ) that under the doctrine of sovereign immunity, the Internal Revenue Service may not be sued in its own name.

Article I, section 3 of the U. S. Constitution stipulates that the Chief Justice shall preside over impeachment trials of the President of the United States in the U. S. Senate.

This is sometimes referred to as " bumping " and appears to contradict the text of the Constitution, which says ( in Article II, section 1, Clause 6 ): The Continuity of Government Commission argued that as well as going against the language of the Constitution, bumping violates the doctrine of separation of powers by undermining the independence of the executive from the Congress:

The Constitution of the United States ( Article I, section II ) directs that the population be enumerated at least once every ten years and the resulting counts used to set the number of members from each state in the House of Representatives and, by extension, in the Electoral College.

These amendments to the Basic Law were mandated by Article I, section 4 of the Two Plus Four Treaty.

A special section of the Bureau set up in accordance with Article 136 shall be responsible for taking all necessary steps to identify children whose identity is in doubt.

The Twenty-first Amendment could not constitute an " independent constitutional bar " to the spending power granted to Congress under Article I, section 8, clause 1 of the Constitution.

Article 3 in the general section of the Geneva Conventions states that in the case of armed conflict not of an international character ( occurring in the territory of one of the High Contracting Parties ) that each Party to the conflict shall be bound to apply, as a minimum, the following provisions to non-combatants:

Under the Knight decision, any action against manufacturing monopolies would need to be taken by individual states, making such regulation extremely difficult with regards to out-of-state monopolies because states are prohibited from discriminating against out-of-state goods by, among other things, the Dormant Commerce Clause and Article I section 10 of the U. S. Constitution.

166 ( October 3, 1913 ), enacted pursuant to Article I, section 8, clause 1 of, and the Sixteenth Amendment to, the United States Constitution, allowing a federal income tax.

The Revenue Act does not violate the uniformity clause of Article I, section 8 of the US Constitution.

Congress asserted its authority to legislate under several different parts of the United States Constitution, principally its power to regulate interstate commerce under Article One ( section 8 ), its duty to guarantee all citizens equal protection of the laws under the Fourteenth Amendment and its duty to protect voting rights under the Fifteenth Amendment.

Article III section I of the Constitution establishes the Supreme Court of the United States and authorizes

Article II section II establishes that all federal judges are to be appointed by the president and confirmed by the United States Senate.

What is required is the full implementation of Article 2 of the Treaty, which provides: `` The Parties will contribute toward the further development of peaceful and friendly international relations by strengthening their free institutions, by bringing about a better understanding of the principles upon which these institutions are founded, and by promoting conditions of stability and well-being.

Article 2, uses of rupees

In the event the total of rupees accruing to the Government of the United States of America as a consequence of sales made pursuant to this Agreement is different from the rupee equivalent of $1,276 million, the amounts available for the purposes specified in paragraph 1, Article 2, will be adjusted proportionately.

With respect to Article 2,, Paragraph 1 ( A ) of the Agreement: ( 1 )

With respect to Article 2,, paragraphs 1 ( B ) and 1 ( C ): Uses of Section 104 ( E ) and Section 104 ( G ) rupees: The Government of India will use the amount of rupees granted or loaned to it by the United States pursuant to paragraphs 1 ( B ) and 1 ( C ) for projects to promote economic development with emphasis upon the agricultural sector including food reserve storage structures and facilities as may from time to time be agreed upon by the authorized representatives of the United States and the authorized representatives of the Government of India, in the following sectors: A.

The Government of India further agrees in cooperation with the Government of the United States, to coordinate the use of grant and loan funds provided for in paragraphs 1 ( B ) and 1 ( C ) of Article 2, with such direct dollar assistance as may be made available by the Government of the United States of America, so that both sources of financing may be channeled to specific and clearly identifiable economic development programs and projects.

With regard to the rupees accruing to uses indicated under Article 2, of the Agreement, the understanding of the Government of the United States of America, with respect to both paragraphs 1 ( B ) and 1 ( C ) of Article 2, is as follows: ( 1 )

Local currency will be advanced or reimbursed to the Government of India for financing agreed projects under paragraphs 1 ( B ) and 1 ( C ) of Article 2, of the Agreement upon the presentation of such documentation as the United States may specify.

The Government of India shall maintain or cause to be maintained books and records adequate to identify the goods and services financed for agreed projects pursuant to paragraphs 1 ( B ) and 1 ( C ) of Article 2, of the Agreement, to disclose the use thereof in the projects and to record the progress of the projects ( including the cost thereof ).

* Article 2 – Freedom of scientific investigations and cooperation shall continue ;

* Afghanistan and the Search for Unity Article on Durrani methods of government, published in Asian Affairs, Volume 38, Issue 2, 2007, pp. 145 – 157.

The definition of the term disposal is made in Article 2 al 4 and just refers to annex IV, which gives a list of operations which are understood as disposal or recovery.

In the United States, the power of the federal judiciary to review and invalidate unconstitutional acts of the federal executive branch is stated in the constitution, Article III sections 1 and 2: " The judicial Power of the United States, shall be vested in one supreme Court, and in such inferior Courts as the Congress may from time to time ordain and establish.

In the European Union member states, Article 2 of the Charter of Fundamental Rights of the European Union prohibits the use of capital punishment.

For example, the Case or Controversy Clause of Article Three of the United States Constitution ( Section 2, Clause 1 ) states that " the judicial Power shall extend ... to Controversies to which the United States shall be a Party ".

Article 2 Item 4 of Law Number 26, October 15, 1997, of the Autonomous Region of Sardinia grants " al dialetto sassarese e a quello gallurese " equal legal status with the other languages on Sardinia.

A partial protection against double jeopardy is a Fundamental Right guaranteed under Article 20 ( 2 ) of the Constitution of India.

To Hammarskjöld, the secession of Katanga was an internal Congolese matter and the UN was forbidden to intervene by Article 2 of the United Nations Charter.

A right to education has been created and recognized by some jurisdictions: Since 1952, Article 2 of the first Protocol to the European Convention on Human Rights obliges all signatory parties to guarantee the right to education.
