`` Article 17, Section 1::

The Secretary of the Treasury, upon the concurrence of the Secretary of State, is authorized and directed, out of the sum covered into the Yugoslav Claims Fund pursuant to subsection ( B ) of this section, after completing the payments of such funds pursuant to subsection ( C ) of this Section, to make payment of the balance of any sum remaining in such fund to the Government of the Federal People's Republic of Yugoslavia to the extent required under Article 1 ( C ) of the Yugoslav Claims Agreement of 1948.

In the event the total of rupees accruing to the Government of the United States of America as a consequence of sales made pursuant to this Agreement is different from the rupee equivalent of $1,276 million, the amounts available for the purposes specified in paragraph 1, Article 2, will be adjusted proportionately.

I have the honor to refer to the Agricultural Commodities Agreement signed today between the Government of the United States of America and the Government of India ( hereinafter referred to as the Agreement ) and, with regard to the rupees accruing to uses indicated under Article 2, of the Agreement, to state that the understanding of the Government of the United States of America is as follows: 1.

With respect to Article 2,, Paragraph 1 ( A ) of the Agreement: ( 1 )

With respect to Article 2,, paragraphs 1 ( B ) and 1 ( C ): Uses of Section 104 ( E ) and Section 104 ( G ) rupees: The Government of India will use the amount of rupees granted or loaned to it by the United States pursuant to paragraphs 1 ( B ) and 1 ( C ) for projects to promote economic development with emphasis upon the agricultural sector including food reserve storage structures and facilities as may from time to time be agreed upon by the authorized representatives of the United States and the authorized representatives of the Government of India, in the following sectors: A.

The Government of India further agrees in cooperation with the Government of the United States, to coordinate the use of grant and loan funds provided for in paragraphs 1 ( B ) and 1 ( C ) of Article 2, with such direct dollar assistance as may be made available by the Government of the United States of America, so that both sources of financing may be channeled to specific and clearly identifiable economic development programs and projects.

With regard to the rupees accruing to uses indicated under Article 2, of the Agreement, the understanding of the Government of the United States of America, with respect to both paragraphs 1 ( B ) and 1 ( C ) of Article 2, is as follows: ( 1 )

Local currency will be advanced or reimbursed to the Government of India for financing agreed projects under paragraphs 1 ( B ) and 1 ( C ) of Article 2, of the Agreement upon the presentation of such documentation as the United States may specify.

The Government of India shall maintain or cause to be maintained books and records adequate to identify the goods and services financed for agreed projects pursuant to paragraphs 1 ( B ) and 1 ( C ) of Article 2, of the Agreement, to disclose the use thereof in the projects and to record the progress of the projects ( including the cost thereof ).

Mr. Justice Black was one of the minority that rested on the Article 1, power.

In this view, supported by only three members of the Court, a power denied by the specific provisions of Article 3, was granted by the generality of Article 1.

The Belgic Confession, used in Reformed churches, devotes a section ( Article 6 ) to " The difference between the canonical and apocryphal books " and asserts that " All which the Church may read and take instruction from, so far as they agree with the canonical books ; but they are far from having such power and efficacy as that we may from their testimony confirm any point of faith or of the Christian religion ; much less to detract from the authority of the other sacred books.

Article I, section 2 of the Constitution states that the House " shall have the sole power of Impeachment ", and Article I, section 3 provides that the " Senate shall have the sole Power to try all Impeachments.

On July 3, 2007, the Court ( through the original three-judge panel ) ruled ( 1 ) that the taxpayer's compensation was received on account of a non-physical injury or sickness ; ( 2 ) that gross income under section 61 of the Internal Revenue Code does include compensatory damages for non-physical injuries, even if the award is not an " accession to wealth ," ( 3 ) that the income tax imposed on an award for non-physical injuries is an indirect tax, regardless of whether the recovery is restoration of " human capital ," and therefore the tax does not violate the constitutional requirement of Article I, Section 9, Clause 4, that capitations or other direct taxes must be laid among the states only in proportion to the population ; ( 4 ) that the income tax imposed on an award for non-physical injuries does not violate the constitutional requirement of Article I, Section 8, Clause 1, that all duties, imposts and excises be uniform throughout the United States ; ( 5 ) that under the doctrine of sovereign immunity, the Internal Revenue Service may not be sued in its own name.

Article I, section 3 of the U. S. Constitution stipulates that the Chief Justice shall preside over impeachment trials of the President of the United States in the U. S. Senate.

This is sometimes referred to as " bumping " and appears to contradict the text of the Constitution, which says ( in Article II, section 1, Clause 6 ): The Continuity of Government Commission argued that as well as going against the language of the Constitution, bumping violates the doctrine of separation of powers by undermining the independence of the executive from the Congress:

The Constitution of the United States ( Article I, section II ) directs that the population be enumerated at least once every ten years and the resulting counts used to set the number of members from each state in the House of Representatives and, by extension, in the Electoral College.

These amendments to the Basic Law were mandated by Article I, section 4 of the Two Plus Four Treaty.

A special section of the Bureau set up in accordance with Article 136 shall be responsible for taking all necessary steps to identify children whose identity is in doubt.

The Twenty-first Amendment could not constitute an " independent constitutional bar " to the spending power granted to Congress under Article I, section 8, clause 1 of the Constitution.

Under the Knight decision, any action against manufacturing monopolies would need to be taken by individual states, making such regulation extremely difficult with regards to out-of-state monopolies because states are prohibited from discriminating against out-of-state goods by, among other things, the Dormant Commerce Clause and Article I section 10 of the U. S. Constitution.

The Revenue Act does not violate the uniformity clause of Article I, section 8 of the US Constitution.

Congress asserted its authority to legislate under several different parts of the United States Constitution, principally its power to regulate interstate commerce under Article One ( section 8 ), its duty to guarantee all citizens equal protection of the laws under the Fourteenth Amendment and its duty to protect voting rights under the Fifteenth Amendment.

When Hong Kong was handed over to China in 1997, Hong Kong retained the common law through a reception statute in Chapter I, Article 8 of the Basic Law of Hong Kong:

Article 8 provides a right to respect for one's " private and family life, his home and his correspondence ", subject to certain restrictions that are " in accordance with law " and " necessary in a democratic society ".

Furthermore, Article 8 sometimes comprises positive obligations: whereas classical human rights are formulated as prohibiting a State from interfering with rights, and thus not to do something ( e. g. not to separate a family under family life protection ), the effective enjoyment of such rights may also include an obligation for the State to become active, and to do something ( e. g. to enforce access for a divorced parent to his / her child ).

Article 8 provides nationals with the right to renounce their nationality, providing they do not thereby become stateless.

A July 8, 1980 New York Times Article titled " What George Steinbrenner is to the American League, Lee Eisenberg is to the Rotisseries League " set off a media storm that led to stories about the league on CBS TV and other publications.

Under clause 17 Article I Section 8 of the Constitution however, Congress has power to " exercise exclusive Legislation in all cases whatsoever " over the federal district ( Washington, D. C .) and other territory ceded to the federal government by the states, such as for military installations.

Coercive plea bargaining has been criticized on the grounds that it infringes an individual's rights under Article 8 of the European Convention on Human Rights, incorporated in the UK's Human Rights Act 1998.

For Europe, Article 8 of the European Convention on Human Rights guarantees the right to respect for private and family life, one's home and correspondence.

In the United States Constitution, Article 1 Section I gives Congress only those " legislative powers herein granted " and proceeds to list those permissible actions in Article I Section 8, while Section 9 lists actions that are prohibited for Congress.

( Under Article I, Section 8, the States have authority for " the Appointment of the Officers.

Under this provision, the Congress may create inferior courts under both Article III, Section 1, and Article I, Section 8.
